Peanut Butter Pumpkin Cups ("we", "us", or "our") respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines our procedure for handling copyright infringement claims and counter-notifications.

If you believe that any content hosted on our website infringes upon your copyright, please follow the procedures outlined below to submit a DMCA notice. Similarly, if you believe your content was removed due to a mistake or misidentification, you may submit a counter-notification.

Filing a DMCA Notice of Infringement

To file a DMCA notice of infringement with Peanut Butter Pumpkin Cups, you must provide a written communication that includes substantially all of the following information. Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material or activity is infringing your copyrights.

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a specific URL).

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to submit a counter-notification. When we receive a valid counter-notification, we will forward it to the complaining party. If the complaining party does not file a court action seeking a court order against you within 10-14 business days of receiving the counter-notification, we may restore the removed material.

To file a DMCA counter-notification, you must provide a written communication that includes substantially all of the following information:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Peanut Butter Pumpkin Cups may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  • Your physical or electronic signature.
